Background Check and Drug Test Consent Form (USA and North Carolina Compliant)

Consent to Future Drug Testing

I understand that while drug testing is not currently required as part of the application process, The OFF MARKET GROUP INC and iPreach Campus reserve the right to enforce drug testing at any point during my employment or volunteer service in the future, in compliance with federal and state laws.

Should drug testing be implemented, I consent to submit to such tests, which may involve the collection of urine, hair, blood, or other necessary samples to detect the presence of illegal drugs, controlled substances, or other substances as deemed necessary by the organization.

I understand that refusal to submit to a future drug test, a positive result, or tampering with the sample may result in disciplinary action, up to and including termination of employment or volunteer services.

North Carolina-Specific Compliance:

If drug testing is enforced in the future, it will comply with North Carolina's Controlled Substance Examination Regulation Act (CSERA). I understand that I will have the right to challenge the results of any positive drug test within the time limits provided by law.

Purpose of Consent

Consent to Background Check

I, the undersigned, authorize The OFF MARKET GROUP INC and iPreach Campus, or its authorized agents, to obtain and review a consumer report and/or investigative consumer report as part of my application process. This report may include, but is not limited to, information about my:

• Criminal history (both national and state-specific)

• Employment history

• Educational background

• Credit history (if applicable and consistent with job duties)

• Personal and professional references

• Motor vehicle records (if applicable)

• Any other relevant records or information that may be necessary for assessing my suitability for the position

I understand that The OFF MARKET GROUP INC and iPreach Campus may use this information to make decisions regarding my employment or volunteer status.

Notice Under the Fair Credit Reporting Act (FCRA):

Under the FCRA, I have the right to request additional disclosures of the nature and scope of the investigative report and to obtain a written summary of my rights. If any adverse employment action is taken based on the information contained in the report, I will be provided with a copy of the report and a written summary of my rights under the FCRA before any action is finalized.

Consent to Drug Test

I also consent to submit to a drug test as part of the application process, in compliance with state and federal laws. I understand that this may involve the collection of urine, hair, blood, or other necessary samples to test for the presence of illegal drugs, controlled substances, or other substances as may be deemed necessary by the organization.

In accordance with North Carolina law, I understand that any drug test conducted will comply with the state's Controlled Substance Examination Regulation Act (CSERA). I also understand that I have the right to challenge the results of any positive drug test within the time limits provided by law.

Disclosure of Information to Third Parties

I authorize The OFF MARKET GROUP INC and iPreach Campus to share the results of my background check and drug test with necessary third parties involved in the employment decision-making process, including but not limited to background check providers and legal counsel.

I certify that the information provided by me is true and accurate to the best of my knowledge. I understand that providing false information or withholding relevant information may result in disqualification from consideration or termination of employment/volunteer services.

I hereby release The OFF MARKET GROUP INC and iPreach Campus, its officers, employees, agents, and any persons or entities that provide information pursuant to this authorization from any and all liabilities, claims, or lawsuits in connection with the information obtained from any and all sources.
